Abstract

Compared with the fierce price competition in 1998, the well‐order price competition is witnessed in Chinese iron and steel industry now and the pricing behaviors of steel firms also follow the certain rules. Based on the methods of collecting the secondary data and interviewing, this paper examines the pricing behaviors of firms to explain the how Chinese steel firms make their pricing decisions and maintain the well‐order competitive relationship among them. The authors found out that (1) most Chinese steel companies adopt a kind of strategic perspective in their pricing decision making, in which understanding of the market trend and the close attention to their competitors are both important; (2) there obviously exists price leader and followers in Chinese iron and steel industry, and the relationship between price leader and followers is relatively stable and the factor behind this phenomenon is the existence of a kind of informal platform of communication among competitors, government and trade associations.

One of the common law duties owed by the employer is his duty to take reasonable care for the safety of his employee. This common law duty is an implied term in the contract of employment and is therefore contractual in nature. Because of the difficulties which may arise in bringing an action in contract for breach of the employer's duty of care, the employee who has sustained injuries during the course of his employment (although he may sue either in contract of tort will normally bring a tort action.

Abstract

Investigates the differences in protocols between arbitral tribunals and courts, with particular emphasis on US, Greek and English law. Gives examples of each country and its way of using the law in specific circumstances, and shows the variations therein. Sums up that arbitration is much the better way to gok as it avoids delays and expenses, plus the vexation/frustration of normal litigation. Concludes that the US and Greek constitutions and common law tradition in England appear to allow involved parties to choose their own judge, who can thus be an arbitrator. Discusses e‐commerce and speculates on this for the future.

Abstract

The purpose of this monograph is to touch on some of the difficulties encountered in the passing of title to goods or the taking of a security interest in goods. The law is in a hopelessly complicated and technical mess which serves neither the interests of consumers or businessmen. It is particularly appropriate to look at this area at this time, as Professor Aubery Diamond, at the request of the Minister of Corporate and Consumer Affairs (Mr. Michael Howard M.P.), is examining the need for alteration of the law relating to security over property other than land. To this end Professor Diamond has issued a Consultation Document in which he poses a number of questions for the legal and business community to consider, it is to be hoped that the Government will act on any proposals produced instead of consigning them to a limbo as was done with the Law Reform Committee's Twelfth Report on ‘Transfer of Title to Chattels’ and with the proposed ‘Lending and Security Act’ suggested by the Crowther Committee on Consumer Credit in 1971.
