This article discusses a surveyor’s responsibility when reporting upon a system built property for mortgage valuation purposes. Recently the Court of Appeal has confirmed that a surveyor was negligent in not recommending further investigation prior to purchase. However conflicting views were expressed by the members of the Court of Appeal regarding the measure of damages payable and these are considered.

When a chartered surveyor first notifies my company of the possibility of a claim such notification may arrive on my desk. With appropriate advice, many of these claims are not pursued against the surveyor. A few may result in some form of payment, if only for reasons of goodwill. However, sometimes the Claimant does not take no for an answer and commences proceedings against his hard done by surveyor.

Abstract
Considers three cases decided in 1993 and 1994 relating to a surveyor′s liability for failing to comment adequately on serious defects in properties when carrying out inspections and reports for mortgage valuation purposes. In two of the cases the judges were so concerned by the condition of the property as to describe its construction as having been “jerry built”. In each of the three cases, a substantial award of damages was made against the surveyors concerned although two of the awards were subsequently reduced on appeal. However, the findings of negligence against the surveyors were upheld.
