Abstract
Purpose
Examines the issues that both employers and employees face in using social media. In particular, focuses on the legal and ethical dilemmas that both sides must address.
Design/methodology/approach
Prior research, statistical trends, and case laws are reviewed.
Findings
Employers using social media for employment decisions may risk crossing several lines, including intrusion into personal privacy. However, social media also offers plenty of opportunities for firms. At the same time, ignoring social media and the way it is used by employees could lead to charges of negligent hiring as well as damages if improper employee messages are posted. Employees have a responsibility to remember that messages considered “private” may still be used as evidence in support of disciplinary actions and could affect the firm’s reputation and their co-workers.
Originality/value
Breaks some new ground in considering this specific employment-related aspect of social media.
