Abstract
Recognizing fertile ground and preparing ground not yet ready is an essential skill of an effective intervenor. This sequence of diagnosis and action is studied in a theoretical framework in which mediators examine and alter four classes of disputants' perceptions. These classes are (1) the available set of actions, (2) the class of possible consequences, (3) the likelihoods of uncertain events and consequences of actions, and (4) preferences over consequences. Denver's increasing demand for water led to the Foothills environmental dispute in 1977. This dispute featured various forms of third party intervention. U.S. Representative Patricia Schroeder's failure to mediate the Foothills conflict, and U.S. Representative Timothy Wirth's success, are compared in terms of the disputants' key beliefs affected by the two self‐appointed intervenors' actions. Using the technique of counterfactual case analysis, an exploration is made of a range of possible timing and ground preparation decisions. Although the particular circumstances of any dispute play a key role in its resolution, the proposed perspective extracts features that are general and therefore transferable to other contexts, thereby enabling mediators to belter develop, transmit, and apply intervention skills.

Abstract
Purpose
This paper aims to contribute to understandings of the dynamics of marketplace exclusion and explore the benefits of a performative approach to knowledge production.
Design/methodology/approach
Interactive documentary theatre is used to explore the pressing issue of marketplace exclusion in a deprived UK city. The authors present a series of three vignettes taken from the performance to explore the embodied and dialogical nature of performative knowledge production.
Findings
The performative mode of knowledge production has a series of advantages over the more traditional research approaches used in marketing. It is arguably more authentic, embodied and collaborative. However, this mode of research also has its challenges particularly in the interpretation and presentation of the data.
Research limitations/implications
The paper highlights the implications of performative knowledge production for critical consumer learning. It also explores how the hitherto neglected concept of marketplace exclusion might bring together insights into the mechanics and outcomes of exclusion.
Originality/value
While theatrical and performative metaphors have been widely used to theorise interactions in the marketplace, as yet the possibility of using theatre as a form of inquiry within marketing has been largely neglected. Documentary theatre is revealing of the ways in which marketplace cultures can perpetuate social inequality. Involving local communities in the co-production of knowledge in this way gives them a voice in the policy arena not hitherto fully addressed in the marketing field. Similarly, marketplace exclusion as a concept has been sidelined in favour of marketplace discrimination and consumer vulnerability – the authors think it has the potential to bring these fields together in exploring the range of dynamics involved.

Clinical Audit has reached a crucial point in its development. In this article, we report the results of a multi‐professional consensus conference held to consider the likely direction of Clinical Audit in the future. In a structured exercise, small groups identified four priority areas: integration of Clinical Audit with research and development, clinical effectiveness and evidence‐based medicine; development of audit methodologies; emphasis on multi‐professional approaches; and incorporation of Clinical Audit into purhasers' and providers' business planning cycles. Reconfigured groups then formulated specific recommendations in each priority area, to be addressed to clinicians, provider managers, purchasers, and the DoH/NHS Executive. Recommendations were validated by all conference practicipants post‐hoc.

Abstract
This paper reviews and investigates the relationship and intersection between three employment developments of the past decade. The restructuring of employment, notably the growth in non‐standard employment forms, the implementation of affirmative action and equal employment opportunity legislation, and the development of enterprise based decentralised bargaining. The central issue investigated is whether the employment conditions of women workers have been enhanced, unaffected or regressed by these developments. Of particular interest is whether enterprise bargaining and employment restructuring are compatible with the implementation of equal employment opportunity (EEO) based employment conditions for women workers. The paper argues that employment restructuring and enterprise bargaining are unlikely to realise the goals associated with EEO legislation, indeed, many women workers will find it difficult to retain existing employment conditions. The paper concludes by examining the likely impact of further individualisation of industrial relations systems on the employment conditions of women workers in Australia.

Over the past several decades, scholars and universities have made efforts to increase the retention of students in higher education, but graduation rates remain low. Whereas two-thirds of high school graduates attend college, fewer than half graduate. The likelihood of graduation decreases even more for Black, Latino, American Indian, and low-income students, who have a 12–15% lower chance of earning their degree. The importance of psychosocial adjustment to student persistence has received relatively less attention than academic and social integration. Racial/ethnic minority students face unique challenges to psychosocial adjustment in college, including prejudice and discrimination, unwelcoming campus environments, underrepresentation, and a lack of culturally appropriate counseling resources. The current chapter will discuss the impact of these challenges on the persistence, academic success, and health of racial/ethnic minority students, and strategies that universities can employ to create inclusive policies, resources and campus environments that empower students of color and maximize their success.

Looks at the 2000 Employment Research Unit Annual Conference held at the University of Cardiff in Wales on 6/7 September 2000. Spotlights the 76 or so presentations within and shows that these are in many, differing, areas across management research from: retail finance; precarious jobs and decisions; methodological lessons from feminism; call centre experience and disability discrimination. These and all points east and west are covered and laid out in a simple, abstract style, including, where applicable, references, endnotes and bibliography in an easy‐to‐follow manner. Summarizes each paper and also gives conclusions where needed, in a comfortable modern format.

Abstract
Purpose
This paper brings attention to the role of hybrid middle managers. In particular it explores the relationship of organisational purpose and role requirements.
Design/methodology/approach
The primary research question for the original research was: What does it mean to hybrid managers to lead and deal with imposed changes (restructuring) to services? A novel narrative approach based on a synthesis of Czarniawska, Gabriel and Boje was applied. Accounts from interviews were condensed into narratives by initially using the categories defined by Gabriel (2000) as epic, tragic, comic and romantic and then further categorised into stories, themes and a serial (Czarniawska, 1997). The final stage of the three-way synthesised narrative approach incorporated Boje’s (2001) notion of “antenarrative” to include pre-emplotment elements.
Findings
Four narratives are provided that give insight to the nature of the struggles the hybrid middle managers were in the midst of. A struggle to address incongruent demands being placed on them that cause tension with their sense of purpose, organisational goals and their hybrid clinical roles and management roles. In the midst of these struggles the narratives illustrate the dynamic of ethical resistance that seeks a way forward. However, this appears to come at a health and well-being cost to the middle managers.
Originality/value
The paper offers up the notion of an added third bind to the traditional double, that of “ethical resistance”, a struggle to align organisational purpose with clinical and management role requirements. Theorising this third bind provides a new insight into understanding the context and dynamics of the hybrid middle manager role and behaviour. Indeed, the idea of ethical resistance may cause a revision of how resistance is understood.

Investigates the differences in protocols between arbitral tribunals and courts, with particular emphasis on US, Greek and English law. Gives examples of each country and its way of using the law in specific circumstances, and shows the variations therein. Sums up that arbitration is much the better way to gok as it avoids delays and expenses, plus the vexation/frustration of normal litigation. Concludes that the US and Greek constitutions and common law tradition in England appear to allow involved parties to choose their own judge, who can thus be an arbitrator. Discusses e‐commerce and speculates on this for the future.
