Abstract

Recent research has suggested that those exposed to passive smoking may incur an increased risk of contracting lung cancer. In the light of such findings, many employers have faced increasing demands from the workforce to introduce smoking policies. The possible legal implications are examined for those employers who fail to introduce such policies and some guidance is offered on the extent to which employment law protects the interests of those workers whose smoking habit makes it difficult or impossible to comply with smoking restrictions.

Abstract

In recent years, various groups of workers have become causes célèbres through being identified by both academics and the media as vulnerable in some way or another. The spectre of child labour in family enterprises causing the children involved to miss school or fall asleep over their books, of homeworkers earning a pittance from boring, repetitive work, of major accidents or the onset of diseases at the workplace, as well as job losses on a massive scale, all indicate that the 1980s have brought or confirmed insecurity and other hardships for vast numbers of workers in the UK. For the purposes of this special edition of Employee Relations, vulnerability connotes disadvantage in the labour market more serious than that derived from simply being atypical or marginal.

Abstract

As we have indicated in the introductory section, the employment protection legislation was drafted principally with full‐time, permanent employees — so called “core workers”— in mind. The legislation of the mid‐70s which established the “statutory floor of employment rights” effectively excluded millions of workers from its protections because they were considered to be self‐employed, or failed to qualify through lack of continuity of employment. Indeed, it may well be argued that, if the policy behind the legislation was to protect those workers which collective bargaining could not reach, the groups who were excluded — the “peripheral workers” — were the ones in the greatest need of protection.

Abstract

Under the European Union’s 1977 Acquired Rights Directive, workers transferred to another employer can expect the majority of their original terms and conditions of employment to be protected and changes made without consultation can constitute constructive unfair dismissal. Confusion over the application of the directive greatly affected the introduction of compulsory competitive tendering to the provision of local authority services in the UK. Many of the issues remain unresolved and will cause problems as compulsory competitive tendering is replaced by the duty on authorities to “achieve best value”. This article seeks to clarify the position for employers by reviewing the most recent case law from both British and European courts.

Abstract

The recent House of Lords decision in Carmichael v. National Power plc decided that a casual/zero‐hours worker was self‐employed and thus excluded from most of the basic employment statutory rights. The aims of this article are to note the incidence and characteristics of the casual workforce in the UK and EU; to explore the current legal framework applying to casual workers, including the decision and implications of Carmichael; to note recent and intended legal measures which have particular relevance for casual workers; to evaluate the likely effectiveness of those recent or proposed legal measures; and to consider possible alternative strategies to establish an appropriate framework for casuals.

Abstract

In the last four years, since Volume I of this Bibliography first appeared, there has been an explosion of literature in all the main functional areas of business. This wealth of material poses problems for the researcher in management studies — and, of course, for the librarian: uncovering what has been written in any one area is not an easy task. This volume aims to help the librarian and the researcher overcome some of the immediate problems of identification of material. It is an annotated bibliography of management, drawing on the wide variety of literature produced by MCB University Press. Over the last four years, MCB University Press has produced an extensive range of books and serial publications covering most of the established and many of the developing areas of management. This volume, in conjunction with Volume I, provides a guide to all the material published so far.

Abstract

THE annual election of the Library Association Council for 1946 is over. Of course, only a small part of the Council has been before the electors. The results follow an old‐established precedent, but are nevertheless curious. Why is it that country members seem not to be interested in their selection of candidates who come from the metropolitan area? There were two to be elected for London and those successful were Frank M. Gardner with 572 and Captain Richard Wright with 501 votes; there were five Country Councillors required and Miss M. F. Austin (854) and Messrs. W. A. Munford (831), F. G. B. Hutchings (817), E. Wisker (716) and E. Osborne (601) were elected. Besides the London candidates who were successful by ballot, Mr. W. B. Stevenson (447) and Mr. E. Sydney (360) will serve on the Council for shorter periods in the room of Mr. J. D. Stewart and S/Ldr. J. D. Cowley. It will therefore be seen that there is considerable disparity in the voting for the two parts of the Council. As we say, this is rather curious as it follows a long established tradition. The new members are Mr. Gardner, Mr. Stevenson, Miss Austin, Mr. Munford and Mr. Wisker; this appears to us to be a very interesting and useful team. They have already shown by definite work, mostly in the A.A.L., that they are qualified leaders amongst the younger librarians. We wish them good fortune in the carrying out of their part in the reconstruction period ahead.

Abstract

WHETHER the political pendulum is to swing in the direction of the Right or not in the coming year we do not know. Local electors are not the only key to national ones whatever politicians may argue. That there will be a move towards that direction is probable as our people tire of the monotonies of any government. Any change will not affect libraries greatly at present as the world problems are too pressing to allow any practical discussion of domestic ones. Our only fear is that “economy” may become a cry, which means, of course, the lopping of things which are educational, cultural and otherwise not money‐making and it is only too probable that public libraries and indeed other libraries might suffer from the modern equivalent of the Geddes axe which some are hopefully expecting. On the other hand the strength of the organizations which control wages from below is such that the disastrous “cuts” of the first Geddes experiment are not likely to be repeated. And on wages the whole of our financial tructure rests. Moreover libraries have now assumed the right to exist in adequate condition and to displace them may not be so easy as it was thirty years ago; but, nevertheless on vigilance our safety still depends. The conditions are not likely at present to be propitious to any real advance. The much‐desired new Library Bill is being drafted—and should be—but its hearing does not seem imminent; the chances of building new libraries are bleak, and even repairs are to some librarians a nightmare. Confronting all these conditions is the greatly increased use of libraries which is reflected in every kind of public, university, national and commercial library. This strengthens faith in the future in spite of the immediate prospect.

Abstract

In a process termed “organizational centrifugalism,” this chapter describes how avant-garde artists sought new, alternative organizational spaces for innovations in the visual arts from the late nineteenth century through the early twentieth century and how new alternative marketspaces co-evolved with these new organizational spaces. Organizational centrifugalism begins with the denouement of the state-run Salon and Academy in the mid-nineteenth century; the rise of the dealer-critic system and other, non-salon alternative exhibition spaces of French Impressionism in the latter half of the nineteenth century; and through many new organizational spaces associated with Modernism such as formal artists groups, museums, great exhibitions, schools of art, and Modernist art itself. The ultimate effect of organizational centrifugalism is drawing avant-garde art closer to the public and eventually the masses. Excessive organizational centrifugalism, however, can be dangerous to the avant-garde art.
