Abstract

Purpose

To explain the impact of a recent decision by the USA Court of Appeals for the Second Circuit on the SEC’s “neither admit nor deny” practice on SEC enforcement matters after the practice was called into question by a federal district court judge.

Design/methodology/approach

Explains the background on the practice of no-admission, the challenge by Judge Rakoff to the practice, and the ruling of the Second Circuit and its practical approach on enforcement matters.

Findings

The ruling should resolve much of the uncertainty that has surrounded court approval of SEC settlements since Judge Rakoff’s decision to question the practice of no-admit or deny settlements. However, recent comments from SEC Chair Mary Jo White and Senior Enforcement Staff suggest that the SEC may continue to seek admissions in certain cases.

Originality/value

Practical guidance from experienced securities and financial services lawyers.

This chapter is concerned with academic citizenry in higher education, and the conditions created within institutions for transformative leadership. This is central to the fitness-for-purpose of higher education institutions to drive the 2030 Agenda for Sustainable Development.

Drawing from a mixed-method study, the chapter explores the patterns which emerged from literature, questionnaire responses, and semi-structured interviews about the problematics at play within six institutions in the post-colonial contexts of India and South Africa. The two upper middle-income contexts have strong constitutional commitments to democracy and social justice at the macro-level, with bold policy interventions undertaken at meso-level to address the legacies of exclusion and oppression in student enrollment and staff composition in HE. However, recent fraught dynamics and unrest within the sector in each country have brought renewed attention to the politics of participation and a breakdown in trust of governance and management.

In this study, the standpoint of key stakeholders was prioritized, including those in assigned leadership positions and academic staff. Particular attention was paid to gender and intersectional inequalities, impacting academic staff, and what they revealed about the persistence of policy-implementation gaps and their relation to principle-implementation gaps. Concerns are raised about impoverished comprehensions of, and conditions for, sustainable ethical leadership which emerged across both contexts.

Abstract

Purpose

The purpose of this paper is to review empirical studies on process mining in order to understand its use by organizations. The paper further aims to outline future research opportunities.

Design/methodology/approach

The authors propose a classification model that combines core conceptual elements of process mining with prior models from technology classification from the enterprise resource planning and business intelligence field. The model incorporates an organizational usage, a system-orientation and service nature, adding a focus on physical services. The application is based on a systematic literature review of 144 research papers.

Findings

The results show that, thus far, the literature has been chiefly concerned with realization of single business process management systems in single organizations. The authors conclude that cross-system or cross-organizational process mining is underrepresented in the ISR, as is the analysis of physical services.

Practical implications

Process mining researchers have paid little attention to utilizing complex use cases and mining mixed physical-digital services. Practitioners should work closely with academics to overcome these knowledge gaps. Only then will process mining be on the cusp of becoming a technology that allows new insights into customer processes by supplying business operations with valuable and detailed information.

Originality/value

Despite the scientific interest in process mining, particularly scant attention has been given by researchers to investigating its use in relatively complex scenarios, e.g., cross-system and cross-organizational process mining. Furthermore, coverage on the use of process mining from a service perspective is limited, which fails to reflect the marketing and business context of most contemporary organizations, wherein the importance of such scenarios is widely acknowledged. The small number of studies encountered may be due to a lack of knowledge about the potential of such scenarios as well as successful examples, a situation the authors seek to remedy with this study.

Abstract

This chapter offers a survey of education development in Sub-Saharan Africa, dynamics of global forces and Sub-Saharan African context. First, the regional context of Sub-Saharan Africa is surveyed. This is followed first by an overview of the incoming tide of global forces impinging on education in the sub-continent, followed by a discussion of education developments in Sub-Saharan Africa as co-shaped by contextual contours. It transpires that the contextual realities of sub-Sahara Africa not only have a powerful mediating role on the impact of global forces but also are in their own right an agency in shaping the education response of societies in the region. The other common thread running through the chapter is the lack of knowledge explicating the interrelationship between education and societal context in the region. This lacunus is evident from the fact that no country in the region has ever been included in international surveys such as the TALIS survey, to lack of research on, for example, informal settlements or the informal economy and its intersection with education. Such research, when placed on the Comparative and International Education research agenda, will not only be of significance to Sub-Sahara Africa, but also to the entire world, many aspects of the contextual architecture of the region are becoming increasingly evident world-wide.

Abstract

The Czech case sheds light on the processes of curriculum making inthe post-socialist context. To explain the relationship between the macro and micro levels of curriculum development, Graeber's concept of interpretive labour is used. In the Czech Republic, from the very first days of the Velvet Revolution (November 1989), groups of citizens and teachers demanded profound change in school education but the new conservative-liberal government preferred piecemeal steps.An alternative route to radical school reform was proposed at the meso level by an alliance of health psychologists and progressive teachers, using the know-how of the World Health Organization. Schools that voluntarily joined the Healthy Schoolnetwork were expected to restructuretheir core processes by an approach similar to school-based curriculum development. This change model was adopted at the macro level,when the Social Democrats formed a government in 1998. The new Education Act mandated that each school had to develop its own curriculum using the new national framework. The analysis of policy documents paving the way for this reform, however, showsa sequence of unfulfilled plans and promises. Almost all independent evaluations have found that the essential goals of the reform have remained unfulfilled, as schools mostly created their curriculaby, for example, formally recycling the old national syllabi.As curriculum making occurs across different levels, the failed curricular reform resulted in a blame game among thelevels(the ministry, curricular agency, inspectorate, school leaders, teachers and others),with no actor accepting theirshare of the responsibilityand probably considering any lessons for future curriculum revisions.
