Abstract

This book is a policy proposal aimed at the democratic left. It is concerned with gradual but radical reform of the socio‐economic system. An integrated policy of industrial and economic democracy, which centres around the establishment of a new sector of employee‐controlled enterprises, is presented. The proposal would retain the mix‐ed economy, but transform it into a much better “mixture”, with increased employee‐power in all sectors. While there is much of enduring value in our liberal western way of life, gross inequalities of wealth and power persist in our society.

Purpose

The purpose is to better understand the way legal mechanisms follow up and support or repress economic growth

Design/methodology/approach

The case of the Israeli R&D Law is presented, and the development of the law is compared to changes in the environment

Findings

The findings show that the legal aspect of economic support laws is significant and that better adaptation to the environment is required.

Practical implications

Areas / countries seeking to enact laws regarding economic growth and R&D support should analyze this example and draw conclusions for their law formulation systems.

Originality/value

This paper is a case study article showing the example of a well documented impact of the legal system on economic growth, and how changes in the environment should be translated without delay, or with minimum delay into the legal framework. It could help policy makers and legal decision makers better understand the impact of such laws.

Abstract

Despite the existence of a variety of approaches to the understanding of behavioral and managerial ethics in organizations and business relationships generally, knowledge of organizing systems for fidelity remains in its infancy. We use halakha, or Jewish law, as a model, together with the literature in sociology, economic anthropology, and economics on what it termed “middleman minorities,” and on what we have termed the Landa Problem, the problem of identifying a trustworthy economic exchange partner, to explore this issue.

The article contrasts the differing explanations for trustworthy behavior in these literatures, focusing on the widely referenced work of Avner Greif on the Jewish Maghribi merchants of the eleventh century. We challenge Greif’s argument that cheating among the Magribi was managed chiefly via a rational, self-interested reputational sanctioning system in the closed group of traders. Greif largely ignores a more compelling if potentially complementary argument, which we believe also finds support among the documentary evidence of the Cairo Geniza as reported by Goitein: that the behavior of the Maghribi reflected their deep beliefs and commitment to Jewish law, halakha.

Applying insights from this analysis, we present an explicit theory of heroic marginality, the production of extreme precautionary behaviors to ensure service to the principal.

Generalizing from the case of halakha, the article proposes the construct of a deep code, identifying five defining characteristics of such a code, and suggests that deep codes may act as facilitators of compliance. We also offer speculation on design features employing deep codes that may increase the likelihood of production of behaviors consistent with terminal values of the community.

Abstract

Purpose

The purpose of this paper is to state new formulation of the programme‐styled framework of pansystems research and related expansions.

Design/methodology/approach

Pansystems‐generalized extremum principle (0**: (dy/dx=0)**) is presented with recognitions to various logoi of philosophy, mathematics, technology, systems, cybernetics, informatics, relativity, biology, society, resource, communications and related topics: logic, history, humanities, aesthetics, journalism, IT, AI, TGBZ* <truth*goodness*beauty*Zen*>, etc. including recent rediscoveries of 50 or so pansystems logoi.

Findings

A keynote of the paper is to develop the deep logoi of the analytic mathematics, analytic mechanics, variational principles, Hilbert's sixth/23rd problems, pan‐axiomatization to encyclopedic principles and various applications. The 0**‐universal connections embody the transfield internet‐styled academic tendency of pansystems exploration.

Originality/value

Abstract

To improve acquisition outcomes, in 1997 the District established the Office of Contracting and Procurement under the direction of a newly created chief procurement officer (CPO). Since then, the District's inspector general and auditor have identified improper contracting practices. This report examines whether the District's procurement system is based on procurement law and management and oversight practices that incorporate generally accepted key principles to protect against fraud, waste, and abuse. GAO's work is based on a review of generally accepted key principles identified by federal, state, and local procurement laws, regulations, and guidance. GAO also reviewed District audit reports and discussed issues with current and former District officials as well as select state and local officials.

Abstract

The competitiveness of companies and their capacity to join markets have changed as a result of the digital economy. One of the reasons the European Commission will revise the rules governing block exemptions for R&D agreements and begin consulting stakeholders in March 2022 is the impact of digitalisation on markets. This chapter looks into how digitalisation has impacted the competitive analysis and evaluation that Moldovan businesses and the competition authority must conduct when looking at R&D collaborations.

For the purposes of the research in this chapter, we used methods such as analysis, deduction, induction, and synthesis of conceptual approaches to the digitalization of the competitive assessment, to elucidate the factors influencing competitiveness in R&D agreements. We also assessed the situation in the Republic of Moldova to formulate conclusions and own opinions about how the introduction of new processes and products on the market will stimulate competition among national firms and will strengthen their ability to compete in regional or even international markets. The recommendations and proposals for improving the management of competence to encourage businesses to innovate collaborate and exchange knowledge to produce innovative goods and services, including green economy solutions and initiatives with the security to comply with a competition policy adapted to the requirements of the new economy, as well as to the new changes in the European competition policy.

Abstract

eCash by DigiCash is one of a range of software‐based systems devised for payments to be made over the Internet by the use of electronic tokens or “coins” (known colloquially as “electronic money”). As in the case of other new electronic systems, the functioning of the system gives rise to novel and difficult legal issues, some of which have yet to be resolved. This article will consider the extent to which a user of the system whose value is stolen may use the common law and equitable tracing rules as a means of taking action against the perpetrator of the fraud.
